Acceptance of Terms

By installing, accessing, or using Brandini through the Shopify App Store, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use the App. These terms are in addition to Shopify's terms of service and any other applicable agreements.

Description of Service

Brandini is a Shopify application that provides AI-powered content generation services, including:

• Brand voice profile extraction from your store content
• AI-generated blog post drafts based on your brand voice
• Content rewriting and copywriting assistance
• Blog scheduling and publishing to your Shopify store
• Image search and integration via Unsplash

Account and Access

To use the App, you must have an active Shopify store and install the App through the Shopify App Store. You are responsible for maintaining the security of your Shopify account and for all activities that occur under your account. You must provide accurate information when using the App and keep your account information up to date.

Subscription and Billing

• Pricing. The App offers various subscription plans with different features and usage limits. Current pricing is displayed in the App and on the Shopify App Store listing.
• Billing. All charges are processed through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge the applicable fees to your payment method on file.
• Free Trial. Some plans may include a free trial period. You will be charged automatically when the trial ends unless you cancel before the trial period expires.
• Cancellation. You may cancel your subscription at any time through the App or Shopify admin. Cancellation takes effect at the end of your current billing period.
• Refunds. Refunds are handled in accordance with Shopify's refund policies for app subscriptions.

Acceptable Use

You agree not to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringe on any third party's intellectual property rights
• Generate spam, misleading content, or content intended to deceive
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's infrastructure
• Violate any applicable laws or regulations
• Resell, redistribute, or sublicense the App without authorization

AI-Generated Content

The App uses artificial intelligence to generate content. You acknowledge and agree that:

• Review required. AI-generated content should be reviewed before publishing. You are responsible for verifying accuracy, appropriateness, and compliance with applicable laws.
• No guarantees. We do not guarantee that AI-generated content will be accurate, complete, error-free, or suitable for any particular purpose.
• Your responsibility. You are solely responsible for any content you publish to your store, regardless of whether it was generated by the App.
• Third-party AI. Content is processed by third-party AI providers (currently OpenAI). Their use of data is governed by their own terms.

Intellectual Property

• Your content. You retain ownership of your store content, inputs, and any content you create or publish using the App.
• Generated content. Content generated by the App using your inputs becomes your property upon generation. You may use it for any lawful purpose.
• Our property. The App, including its design, features, code, and documentation, remains our intellectual property. These terms do not grant you any rights to our trademarks, logos, or brand elements.
• Feedback. If you provide feedback or suggestions about the App, we may use them without obligation to you.

Privacy and Data

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using the App, you consent to our data practices as described in the Privacy Policy.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the App. The App may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue any part of the App at any time with or without notice.

Limitation of Liability

To the maximum extent permitted by law, Brandini and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any content generated by or through the App
• Unauthorized access to or alteration of your data
• Any third-party conduct or content
• Any other matter relating to the App

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements, be error-free, or that any defects will be corrected.

Indemnification

You agree to indemnify and hold harmless Brandini and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these terms, or your violation of any rights of a third party.

Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections of these terms that by their nature should survive termination will survive, including intellectual property, limitation of liability, and indemnification.

Changes to Terms

We may update these terms from time to time. If we make material changes, we will update the effective date and may notify you through the App or by other means. Your continued use of the App after changes take effect constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of the jurisdiction in which Brandini operates, without regard to conflict of law principles. Any disputes arising from these terms or your use of the App shall be resolved in the courts of that jurisdiction.
